Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Roof Visualizer Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Roof Visualizer Pro is a software platform for roofing professionals that enables AI-powered visualization of different roof colors, materials, and styles on property photos. The Service includes:

• AI-powered roof visualization generation
• A product catalog of manufacturer roofing products, colors, and materials
• Branded visualizer creation and embedding (Pro tier)
• Lead capture and CRM tools (Pro tier)
• Team and organization management
• Batch visualization processing
• Image storage and download

The Service is provided as a sales and presentation tool. Visualizations are AI-generated approximations and may not exactly replicate the appearance of actual roofing products. They should not be relied upon as exact color or material representations.

3. Eligibility

• You must be 18 years or older to use this Service
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Subscription Plans and Payments

Plans

Roof Visualizer Pro offers subscription tiers (Starter, Pro, and Elite) with different feature sets and usage limits. Current pricing and feature details are available on our Pricing page. We reserve the right to modify pricing with 30 days' notice.

Billing

• All subscriptions are billed monthly or annually through Stripe, regardless of whether you use the web application or mobile app
• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage or cancel your subscription at any time from your dashboard settings or via the Stripe customer portal
• The mobile app does not process payments through Google Play or Apple App Store
• Refunds are available under our 24-Hour Satisfaction Guarantee

Batch Credits

Batch visualization processing uses a credit-based system. Credits are purchased separately and are non-refundable once consumed. Unused credits remain in your organization's balance indefinitely. Credits deducted for failed batch items are automatically refunded to your balance.

5. Free Trial

New subscribers may choose an optional 7-day free trial at checkout. A valid credit card is required to start a trial. The trial is limited to one per user, regardless of plan tier.

Trial Limits

• All trials include a maximum of 30 visualizations, regardless of the selected plan tier
• During the trial, all visualizations include a locked watermark ("Roof Visualizer Pro — Free Trial"). Watermark customization is available only after your first payment
• All other features of your selected tier (CRM contacts, team seats, tools, etc.) are fully unlocked during the trial
• If you do not cancel before the trial ends, your selected plan begins automatically at its listed price and your full tier visualization limits unlock

You may also skip the trial and pay immediately at checkout for instant access to your full plan limits. We reserve the right to revoke trial access if we detect abuse, such as creating multiple accounts to circumvent limits.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload inappropriate, offensive, or illegal content
• Attempt to reverse engineer, decompile, or modify the Service
• Share your account credentials with unauthorized parties
• Use the Service to misrepresent products or services to customers
• Circumvent rate limits, usage restrictions, or access controls
• Scrape, crawl, or otherwise extract data from the Service by automated means
• Use the Service to send spam or unsolicited communications
• Interfere with or disrupt the integrity or performance of the Service
• Upload images that you do not have the right to use

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. User Content and Ownership

You retain ownership of all photos and images you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.

Generated visualizations are derivative works created by our AI engine using your uploaded photos. You may use generated visualizations for your business purposes, including sales presentations, proposals, and marketing materials, subject to any applicable manufacturer trademark guidelines for the products depicted.

8. Intellectual Property

The Roof Visualizer Pro platform — including its design, user interface, features, AI models, and code — is owned by Roof Visualizer Pro LLC. All rights reserved. Manufacturer product names, colors, shingle profiles, and branding remain the property of their respective owners (GAF, Owens Corning, CertainTeed, IKO, TAMKO, Atlas, Malarkey, and others).

9. Branded Visualizers and Embedding (Pro Tier)

Pro tier subscribers may create branded visualizers with custom logos, colors, and embed them on third-party websites. When you embed a branded visualizer:

• You are responsible for ensuring your use complies with applicable laws in the jurisdictions where the visualizer is displayed
• You must not remove or obscure the "Powered by Roof Visualizer Pro" watermark unless your plan explicitly permits it
• Lead data collected through your branded visualizer is your responsibility to handle in compliance with privacy laws (including GDPR, UK GDPR, PIPEDA, and the Australian Privacy Act where applicable)
• We are a data processor for lead data captured through your branded visualizer; you are the data controller

10. Organizations and Teams

Organization owners and admins can invite team members, manage roles, and control access to shared resources. The organization owner is responsible for ensuring that all team members comply with these Terms. We are not liable for actions taken by individual team members within an organization.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• Visualizations will exactly match actual roofing products in color, texture, or appearance
• The Service will be uninterrupted, error-free, or continuously available
• AI-generated results will be accurate in all conditions or lighting
• The Service will meet your specific requirements

Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions apply to the maximum extent permitted by applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Roof Visualizer Pro LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from your use of the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amounts you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death, personal injury, or fraud.

13. Indemnification

You agree to indemnify and hold harmless Roof Visualizer Pro LLC from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you upload to the Service.

14. Account Termination

You may delete your account at any time through our Account Deletion page. Upon deletion:

• Your account and profile will be permanently deleted
• Active subscriptions will be cancelled
• This process may take up to 30 days to complete across all systems

Data Retention Exception: We may retain uploaded photos, generated visualizations, and associated usage records in anonymized or archived form for purposes of abuse prevention, fraud investigation, legal compliance, and service integrity. These retained records are not accessible to deleted accounts and are subject to our standard data security practices.

We may also suspend or terminate your account at any time for violations of these Terms or for any reason with reasonable notice.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in North Carolina.

If you are a consumer in the European Union, United Kingdom, Australia, New Zealand, or Canada, nothing in these Terms affects your statutory rights as a consumer under the mandatory consumer protection laws of your jurisdiction. You may bring proceedings in the courts of your country of residence.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
